Trustees
In some instances, creditors have a right to elect a person of their own choosing as a Trustee in Bankruptcy. Usually, creditors do not exercise that right, and they allow one to be appointed by the court. A Trustee takes possession or ownership of a debtor’s property and assets, sells them, and uses the cash proceeds to pay allowable expenses and distributes the balance to the creditors.
In a Chapter 13 Bankruptcy, the Trustee will receive monthly payments from the debtor and distribute those funds to creditors.
In cases involving particular legal issues or proceedings, bankruptcy trustees frequently will use the services of attorneys to assist with the administration of the estate. Bankruptcy Trustees have retained Golden & Golden, P.C., to provide legal services and assistance.
