Under a new bankruptcy law (the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005), it is now harder to file Chapter 7 bankruptcy. Chapter 7 bankruptcies now risk being dismissed OR are converted to Chapter 13 (where a larger portion of the debt must be paid).
A bankruptcy petition can still be filed without a lawyer. However, the new law contains legal traps. The risk of a technical error is high. Although bankruptcy judges can be very sympathetic to situations that caused an error, in many instances they have absolutely no choice but are simply forced to dismiss a case. To avoid the traps and procedural pitfalls under the new law, both the American Bar Association and the American Bankruptcy Institute strongly advise anyone filing bankruptcy to hire a lawyer.
